The Patna High Court, serving as the judicial cornerstone of Bihar, came into existence on 9 February 1916, under the Government of India Act 1915. The court, headquartered in Patna, the administrative capital of Bihar, was established following the proclamation made by the Governor-General of India on 22 March 1912. This proclamation elevated the territories of Bihar and Orissa to the status of a separate province, leading to the formation of the Patna High Court by Letters Patent on 9 February 1916.
Before this establishment, the jurisdiction of the High Court of Judicature at Fort William in Bengal covered the regions now under the Patna High Court. With the publication of the Letters Patent in the Gazette of India on 26 February 1916, the High Court of Judicature at Fort William ceased to exercise jurisdiction in various matters, including Civil, Criminal, Admiralty, Matrimonial, Testamentary, Intestate, and Enrolment, all of which were now under the purview of the newly formed Patna High Court.
The foundational stone for the High Court Building was laid on 1 December 1913, by Lord Hardinge of Penshurst, the then Viceroy and Governor-General of India. During the ceremony, Lord Hardinge emphasized the administrative anomaly of having the people of Bihar and Orissa litigate beyond the province’s limits, highlighting the inconveniences of distance, cost, and time. Expressing confidence in the future, he envisioned the High Court of Bihar as a beacon of justice, administering courage and impartiality, earning a reputation for sound sense and good law.
In 1916, the High Court commenced its operations with Sir Edward Maynard Des Champs Chamier as its first Chief Justice, along with several Puisne Judges. Today, the Patna High Court stands as a venerable institution, upholding the principles of justice in the state of Bihar.
